The Community Empowerment (Scotland) Act 2015 gives community organisations the right to request ownership, lease or management of land and buildings owned by public bodies such as Fife Council, NHS Fife and the Scottish Government. The public body must consider the request and can only refuse it for good reasons.
To make an asset transfer request your organisation must be a community transfer body, with a constitution that meets the Act's requirements, and you will need a strong case: what you will do with the asset, how you will pay for it, and the benefits to the community. Fife Council publishes its asset transfer process and a register of its property.
FVA can help you check that your constitution qualifies, develop the business case and prepare the request. Talk to us early; a good request takes months to prepare.
