Laws and regulations

The main laws that apply to charities, community groups and social enterprises in Scotland, and where to get help understanding them.

Nobody expects a volunteer committee to be lawyers, but the people who run an organisation are responsible for keeping it within the law. The areas that come up most often are:

  • Charity law: the Charities and Trustee Investment (Scotland) Act 2005 and OSCR's requirements on trustees, accounts, notifiable events and changes to your constitution.
  • Company law: for companies limited by guarantee and CICs, filing at Companies House and directors' duties.
  • Data protection: UK GDPR and the Data Protection Act 2018.
  • Employment law, if you employ staff, and health and safety law for everyone.
  • Safeguarding: PVG membership and disclosure checks for regulated work with children and protected adults.
  • Fundraising, licensing and lotteries, and the rules for public collections and events.

FVA's capacity building team gives free advice on how the law applies to your situation and can refer you to specialist legal advice when it is needed.
