    Disclosure Scotland have produce a guide for organisations providing health services, and other services in healthcare settings. This guidance is intended to help organisations in the health service make informed decisions on what types of roles requires PVG scheme membership.

    Changes to health services PVG

    Individuals carrying out many (but not all) of the roles in a health service or healthcare setting will be required to join the Protecting Vulnerable Groups scheme (PVG scheme). Regulated roles in the health service are mostly roles that were also previously considered to be “regulated work” under previous legislation, along with certain non-clinical roles that are now regulated roles.

    There will also continue to be certain roles, even in a hospital or hospice setting, that are not regulated roles, for example, back-office roles that do not include the type of activities and contact described in this guide as a necessary part of their role.

    Once a health service or healthcare setting role has been identified as a regulated role, you (the individual) are legally required to be a member of the PVG scheme for children, protected adults, or both groups – depending on who you’ll be working with.

    Regulated roles 

    A regulated role in the health service or in a healthcare setting is where an individual is carrying out a role for that group that means they are carrying out an ‘activity’ and have ‘contact’ with children and/or protected adults as a necessary part of their role. It can be paid work, unpaid work or work under a contract for services.

    It is not possible to provide an exhaustive list of roles, positions or duties that would constitute a regulated role. This is because the structure and descriptions of the roles that people do in health service or healthcare setting roles can change and vary, dependant on the organisation and type of work being carried out.

    However, there are some roles in the health service where it is clear it is a regulated role. These are set out in a list organised by sector and published on Disclosure Scotland’s website. Where your role appears on this list, this means that you require PVG membership to carry out your role.
