Mayor Turner asked for moment of silence to remember Jack Parish who passed away last week.  She noted that he was a valued member of the community who served as mayor and councilmember for the City of Puyallup and as a board member for the Puyallup School District.

 

APPROVAL OF THE AGENDA

 

Council Action: A motion was made by Councilmember Malloy, second by Councilmember Deal, to approve the agenda with one change to move the resolution recognizing the Vietnamese Flag to follow the presentation by the Vietnamese-American Community regarding the display of the Heritage Flag of Vietnam.  The motion passed 6-0.

 

CONSIDERATION OF MINUTES

 

Council Action: A motion was made by Councilmember Eckerson, second by Councilmember Martin, to approve the minutes of the regular meeting of November 17, 2003.  The motion passed 6-0.

 

PRESENTATIONS AND PROCLAMATIONS

 

Proclamation declaring the week of December 1-7, 2003 as "Giftmaker's Week"

 

Mayor Turner read and presented the proclamation to Giftmakers.  Ms. Karen Hansen thanked the Council and explained that Giftmakers was a program of the Puyallup School District to provide gifts to disadvantaged families in the Puyallup area.  Ms. Stephanie Trent and Ms. Zanetta Im from Roger’s High School and Girl Scout representative Amber Rhodes from Puyallup High School spoke about how the gifts are donated to Giftmakers and given to needy families. 

 

Presentation by the Vietnamese-American community regarding the display of the Heritage Flag of Vietnam (see resolution)

 

Dr. Huy Tuong Nguyen spoke on behalf of the Vietnamese-American community leaders in Pierce County and asked the City Council to support the display of the Heritage Flag of Vietnam.  He noted that they have displayed their flag along with the United States of America Flag on Armed Forces Day, Veteran’s Day, Memorial Day and at rallies in support of our troops.  Their flag symbolizes the Vietnamese-Americans belief in democracy, freedom and equality and felt the City’s support to adopt the resolution would build a stronger bond with the Vietnamese-American community.

 

Mr. Hung Nguyen explained the importance of the Heritage of Vietnam flag to Vietnamese-Americans.  He explained that the flag represents the mass exodus of two million South Vietnamese who sought freedom and democracy during the “fall of Saigon” in 1975.  He thanked the Mayor and Council for their support of their flag and explained that the yellow background represents the ancestral land and the territory and national sovereignty, and the three red bands represent the three regions of Vietnam.

 

Resolution recognizing the Vietnamese-American Community and its display of the Heritage Flag of Vietnam 

 

Mayor Turner read the resolution and expressed her appreciation to the Vietnamese-Americans for bringing this matter to her attention.

 

Council Action:  A motion was made by Councilmember Malloy, second by Councilmember Martin, to approve the resolution.  The motion passed 6-0.

 

RESOLUTION NO. 1834

 

A RESOLUTION of the City Council of the City of Puyallup recognizing the Vietnamese-American Community and its display of the Heritage Flag of Vietnam, a yellow flag with three red stripes.

 

CITIZEN COMMENTS

 

Ms. Barbara Volin, 619 7th Avenue Southeast, Puyallup, explained that the city owns a building in Puyallup called the PAM Group Home (People Aiding the Multi-handicapped) and she asked that the City bequeath ownership of the group home to the organization, or provide financing so PAM could purchase the building and build an addition to the facility.  She noted that the City purchased the facility about 25 years ago with funding from a Referendum 29 Federal Grant and PAM was told that that they would own it after 25 years. Mr. Bacon responded that he would discuss it with Council and get back to her.

 

Cathleen Cullison, 8204 99th Street Court East, Puyallup, noted that she received a letter from Mr. Bacon with the forms to begin the annexation process into the city and then she would be able to have utilities connected at her property.  Mr. Bacon explained that the petition to annex needed to be signed by at least ten percent of the property owners of an area that borders the city and includes Ms. Cullison’s property.  He added that Mr. Stidham was working to get the necessary signatures and hoped to have them by the next council meeting.  Ms. Cullison explained that all she wants is a pre-annexation utility extension agreement and Mr. Bacon explained that because of the drastic changes to annexation laws she needs to pursue the annexation process.  Mr. Bacon added that he would talk with Ms. Cullison and Mr. Stidham.

 

Mr. John Williams, Human Resources Director, commended Ms. Stori Sanders for all her efforts to meet the requirements for the City to become self-insured for worker’s compensation.  Today, he received a call from the State Department of Labor and Industries that the City’s Safety and Health Program had successfully passed the review to become self-insured.  He added that it is very unusual to pass on the first try and noted that this change will have a significant impact on costs to the city.

 

Mr. Doug McCormick explained that Puyallup is one of ten cities in the nation that was selected to participate in a study to determine the ‘elder friendliness’ of Puyallup.  The AdvantAge Initiative of Puyallup Task Force will give a briefing of the results of the study at a meeting on December 11, at 2:00 p.m. at the Library.  Mr. Rick Crozier from the Task Force was unable to attend this meeting but asked that the City Council be invited to attend the meeting.

 

Ms. Norma Knittel, 1420 4th Street Southeast, Puyallup, expressed concerns with the Good Samaritan Master Plan regarding parking.  She noted that the entrance to the proposed expansion would be across the street from her husband’s medical office and would create a greater parking problem than already exists.  Their facility has exceeds the number of parking spaces than are required but there have been occasions when patients could not keep their appointments because they could not park in the doctor’s parking lot.  She asked that consideration be given to the parking situation and suggested the entrance to the emergency room expansion be placed on the opposite side of the building facing 5th Street Southeast which would be closer to other parking areas. 

 

Mr. George Govier, CEO from Good Samaritan Hospital, responded to Ms. Knittel’s comments and explained that the hospital was committed to provide parking.  He noted that a lot of thought had gone into the location of the entrance to the emergency room expansion and to change that would be problematic.

 

Ms. Jennifer Witt, PO Box 1622, Port Orchard, spoke about the Good Samaritan Master Plan which assumes the street vacation of 14th Avenue Southeast.  She explained that other hospitals have dealt with similar issues by building a bridge over the roadway or an underground tunnel.  She noted that it is critical that Council look at this issue at this time and asked what else was contingent with the master plan besides the street vacation. 

 

CONSENT AGENDA

 

Authorizing the execution of a memorandum of understanding with the Puyallup Police Officers Association (PPOA) to establish a list for acting and promotional appointments

 

Authorizing the execution of a professional services agreement with Robert W. Droll, Landscape Architect in the amount of $45,907.60 for the design of Puyallup River Trailhead Improvements

 

Authorizing the execution of a contract with Thomas Cook Reed Reinvald Architects in the amount of $24,584.50 for the design of improvements to the Memorial Community Center

 

Authorizing the execution of a contract with Berger/Abam Engineers, Inc. not to exceed $50,000 for preparation of a South Hill Urban Center Urban Design Plan

 

Authorizing the execution of a professional services agreement to retain Penser North America, Inc. in the amount of $10,000 as the third party administrator for the City’s self-insured workers compensation program

Council Action:  A motion was made by Councilmember Deal, second by Councilmember Martin, to approve the consent agenda.  The motion passed 6-0.

 

ORDINANCES

 

Second reading of ordinance amending the City of Puyallup Comprehensive Plan, Future Land Use map, and the City’s Zoning map

 

Council Action:  A motion was made by Councilmember Martin, second by Councilmember Deal, to move the second reading of the ordinance to December 15, 2003.  The motion passed 6-0.

 

Second reading of an ordinance adopting the proposed Good Samaritan Hospital Master Plan

 

Mr. McLean explained that approval of the master plan in no way obligates the Council to approve the street vacation identified in the master plan. Councilmember Deal was not comfortable with the closing of 14th Avenue Southeast.  Councilmember Malloy asked if there was another alternative to closing 14th Avenue.

 

Mr. Michael Borelli, Good Samaritan Planning and Development, noted that 15th Avenue Southeast had been considered as an alternative to vacating 14th Avenue Southeast.  He explained that the master plan was preceded by the environmental impact statement (EIS) which reflects the vacation of 14th Avenue and was approved by the Council.  He added that they intend to meet all the requirements but proceeded with the master plan based on the Council’s approval of the EIS.  In addition to the site plan they intend to meet the parking requirements by the end of each phase of development.  He explained that they are very sensitive to the parking issues and intend to make every effort to provide adequate parking.  Other options that were considered were over-ground and underground access but would be too costly considering the grade and elevation, and Mr. McLean added that the city’s municipal code does not allow for bridges over streets. Council expressed concerns about parking and Councilmember Martin agreed with Councilmember Deal about not closing any streets but did not want to delay approval of the master plan.

 

Council Action:  A motion was made by Councilmember Malloy, second by Councilmember Barstow, to approve the second reading of the ordinance.  The motion passed 5-1 (Deal).

AN ORDINANCE of the City Council of the City of Puyallup, Washington, relating to the acquisition by eminent domain of a certain portion of property in the City of Puyallup, located at 325 South Meridian, necessary for future development of public buildings and squares associated with the Civic Center project; directing staff to exhaust all reasonable negotiation efforts to purchase property necessary for the project, describing the public convenience, use and necessity of such property; providing for the condemnation, appropriation and use of the property; providing the mode of payment of cost of acquisition of the property; and directing the City Attorney to prosecute such action in Pierce County Superior Court in the event direct purchase efforts are not successful.

Second reading of an ordinance amending Chapter 10.40 establishing a new no parking zone for trucks on 23rd Avenue NW between 7th Street NW and SR 161

Council discussed including the no parking zone for trucks along the eastside of Valley Avenue but agreed to wait a few months to see if it was necessary.

ORDINANCE NO. 2768

 

AN ORDINANCE of the City Council of the City of Puyallup, Washington, amending Chapter 10.40 of the Puyallup Municipal Code named “Restricted Parking Areas – Time Limits” and adding a new section relating to a no parking zone on 23rd Avenue NW within the City of Puyallup.

 

First reading of an ordinance annexing approximately 116 acres located south of Pioneer Way East and north of the existing Puyallup city limits, east of Shaw Road, known as the Puyallup Highlands Annexation Area

 

Mr. Bacon explained that the annexation was submitted because the request for pre-annexation utility extension was denied.

 

Council Action:  A motion was made by Councilmember Barstow, second by Councilmember Martin, to approve the first reading of the ordinance.  The motion passed 6-0.

 

Council Action:  A motion was made by Councilmember Eckerson, second by Councilmember Martin, to set a public hearing for December 15, 2003 and direct the City Clerk to publish notice of such hearing through publication in a newspaper of general circulation in the city and the proposed annexation area, and through posting of a hearing notice in three public places within the territory proposed for annexation, which notices should specify the time and place of the hearing and invite interested persons to appear and voice approval or disapproval of the annexation.  The motion passed 6-0.

 

First reading of an ordinance regulating the placement of newsstands within public rights-of-way in the downtown area

 

Mr. Bacon explained that Council approved the first reading of a similar ordinance at the end of 2002 but due to some changes and the long time between readings it was best to have another first reading of the ordinance.  Mr. McLean noted that he would clarify at the second reading of the ordinance, the requirements of a newsstand vendor regarding the selling or trading of their permit.

 

Council Action:  A motion was made by Councilmember Barstow, second by Councilmember Malloy, to approve the first reading of the ordinance.  The motion passed 6-0.

 

CONSIDERATIONS AND REQUESTS

 

Mr. Bacon noted that there was adequate funding available in the REET (Real Estate Excise Tax) Fund for the purchase of the following three properties (Arndt, Kuhr and Osborne).

 

Request to authorize the City Manager to purchase Arndt property located at 802 30th

Avenue SW for future public use currently planned to be the site of a new fire department facility

 

Council Action:  A motion was made by Councilmember Malloy, second by Councilmember Barstow, to authorize the purchase of the Arndt property located at 802 30th Avenue SW, Puyallup (Pierce County parcel number 0419041085) in the amount of $300,000 and authorize the City Manager to sign documents required to effectuate the transaction substantially in a form as approved by the City Attorney.  The motion passed 6-0.

 

Request to authorize the City Manager to purchase Kuhr property located at 710 30th Avenue SW for future public use currently planned to be the site of a new fire department facility

 

Council Action:  A motion was made by Councilmember Malloy, second by Councilmember Deal, to authorize the purchase of the Kuhr property located at 710 30th Avenue SW, Puyallup (Pierce County parcel number 0419041083) in the amount of $492,000 and authorize the City Manager to sign documents required to effectuate the transaction substantially in a form as approved by the City Attorney.  The motion passed 6-0.

 

Request to authorize the City Manager to purchase the Osborne property located at 3015 Ninth Street SW for future public use currently planned to be the site of a new fire department facility

 

Council Action:  A motion was made by Councilmember Eckerson, second by Councilmember Deal, to authorize the purchase of the Osborne property located at 3015 Ninth Street SW, Puyallup (Pierce County parcel number 0419041056) in the amount of $340,000 and authorize the City Manager to sign documents required to effectuate the transaction substantially in a form as approved by the City Attorney.  The motion passed 6-0.

 

CITY MANAGER AND STAFF REPORTS


Mr. Bacon spoke about the new Public Market and that the Farmers Market will be managed by Main Street Association.  Mr. Dannenberg introduced Ms. Sarah Harris who will be the Public Market Supervisor.  

 

Ms. Susan Nobles, Main Street Association, added that they are very excited about managing the Farmer’s Market in 2004 and noted some of the changes including extending the season and the market will be open an hour longer and on Sundays (June to October).

 

COUNCIL REPORTS

 

Councilmember Malloy expressed concern that Puyallup does not have 24-hour angioplasty capabilities and the nearest facility is Tacoma and asked Mr. Bacon to inquire from Dr. Snodgrass about the protocol to have that capability in Puyallup.  He congratulated staff, Mr. Heinecke and Mr. McLean on the great job in repairing the 6” water main near his home last week and noted that a crew worked until 4:00 a.m. and returned a few hours later to clean up the area.

 

MAYOR'S REPORT

 

Mayor Turner noted that the Santa Parade is scheduled for December 6, 2003.  She commended Police Officer Sonny Subido who organized a group of volunteers at the Rose Café on Thanksgiving Day to serve over 60 dinners and deliver 40 dinners.  She asked if any Councilmembers were interested in attending the AWC Newly Elected Officials class in January and to notify Stephana Coffey if they wish to attend.  The ceremonial swearing in of the new and re-elected Councilmembers will be at the Community Resource Center on Wednesday, January 7, 2004, at 4:00 p.m.

 

Council discussed future consideration of a moratorium on pre-annexation utility extension agreements and Mayor Turner felt it was important to get public comments prior to approving a moratorium.

 

EXECUTIVE SESSION

 

Mayor Turner called for executive session for approximately 15 minutes to discuss property acquisition.  Council, Mr. Bacon, and Mr. McLean recessed to executive session at 9:48 p.m. and reconvened at 10:03 p.m. to announce that the session would be extended approximately ten minutes longer.  Council returned to executive session at 10:04 p.m. and reconvened to regular session at 10:14 p.m.  No action was taken.
